1. Acceptance and scope
These Terms of Use govern access to the Presell personalized demo and related features provided by Presell AI Solutions. By using the service, you agree to these Terms and acknowledge the Privacy Notice. If you use the service for an organization, you confirm you have authority to bind it.
You must be at least 18 and legally able to enter these Terms. If you do not agree, do not use the service.
2. What the demo is
Presell creates a temporary sales-system demonstration using a submitted development website, public-source enrichment and connected communication providers. Unless expressly stated, the demo is illustrative and is not sponsored, approved by or affiliated with the development, website owner, broker or listing party.
The demo does not create a brokerage, agency, fiduciary, employment or professional-adviser relationship. It is not real-estate, legal, tax, financial or investment advice.
3. Your submissions and authority
You may submit only websites and information you are legally permitted to use for this purpose. You represent that you have authority to provide the telephone number, email address and other information entered, and that you will not impersonate another person or cause communications to be sent without authorization.
You retain rights in content you lawfully provide. You grant Presell a limited, worldwide license to access, process, reproduce and transform that content only as needed to provide, secure, analyze and improve the service. Public website content remains subject to its owners' rights.
4. Automated calls, WhatsApp and email
A call is initiated only after the applicable form and consent are submitted. Optional WhatsApp and email follow-up requires the indicated choice. Consent is not a condition of purchase. You are responsible for the accuracy of the destination and any carrier charges.
You may withdraw from marketing communications at any time using the channel instructions or privacy@presellai.co. Transactional or security notices may still be sent where appropriate.
5. AI and public information
Automated extraction, search enrichment, transcription, analysis and generative AI can produce errors, omit context or reflect stale public sources. Pricing, availability, amenities and other project facts must be confirmed directly with an authorized project representative before reliance.
You are responsible for reviewing output before publishing, sharing or using it to make decisions. Do not use scores or profiling as the sole basis for decisions that materially affect a person.
6. Third-party services
The service may rely on or link to third-party voice, telephone, messaging, AI, email, scheduling, security, hosting and data services. Availability and processing may depend on those providers. Their terms and privacy notices may apply to your direct use of their services. Presell is not responsible for third-party services outside our control.
7. Acceptable use
You may not use the service to violate law or third-party rights; scrape restricted or private systems; submit malware; probe or bypass security; evade invitations, budgets or rate limits; automate mass submissions; send spam or unlawful calls/messages; impersonate others; harvest personal data; interfere with operation; reverse engineer protected portions; or use output to deceive consumers.
We may suspend, limit or block activity we reasonably believe is abusive, unsafe, unlawful or costly to the service or others.
8. Presell rights
Presell and its licensors own the service, design, software, workflows, prompts, models, branding and related intellectual property, excluding third-party and user content. No rights are granted except the limited right to use the demo under these Terms. Feedback may be used without restriction or compensation.
9. Availability and changes
We may change, pause or discontinue the demo, a feature, provider, limit or access method at any time. We do not promise uninterrupted availability, delivery of every call or message, preservation of every temporary interface state, or compatibility with every website, country or device.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." PRESELL DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND RESULTS. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESELL AI SOLUTIONS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITIES ARISING FROM THE DEMO.
For claims that may not be excluded, our aggregate liability arising from the demo will not exceed the greater of USD $100 or the amount you paid Presell for the demo during the three months before the event giving rise to the claim. This limitation does not apply where prohibited by law.
12. Indemnity
To the extent permitted by law, you will defend and indemnify Presell from third-party claims arising from your unlawful use, your submissions, communications you direct without authority, or your violation of these Terms or third-party rights.
13. Governing law and disputes
Florida law governs these Terms without regard to conflict rules. Courts located in Miami-Dade County, Florida will have exclusive jurisdiction, unless mandatory consumer law gives you the right to proceed elsewhere. Before filing a claim, the parties should attempt in good faith to resolve it by written notice.
14. General terms
If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the service. These Terms and the Privacy Notice are the complete agreement for the demo unless a separate written agreement applies.
15. Changes and contact
We may update these Terms. The effective date identifies the current version; continued use after an update constitutes acceptance to the extent permitted by law.
